Smart working e proroga stato d&#8217;emergenza"},"content":{"rendered":"<p style=\"text-align: justify;\">Nella Gazzetta Ufficiale del 7 ottobre 2020 n. 248 \u00e8 stato pubblicato il decreto-legge 7 ottobre 2020 n. 125 relativo alle misure urgenti connesse con la proroga della dichiarazione dello stato di emergenza epidemiologica da COVID-19 e per la continuit\u00e0 operativa del sistema di allerta COVID.<\/p>\n<p style=\"text-align: justify;\">Con tale decreto \u00e8 stato spostato al 31 gennaio 2021 il termine dello\u00a0stato di emergenza legato all&#8217;epidemia da COVID-19, che era stato precedentemente fissato al 15 ottobre 2020.<\/p>\n<p style=\"text-align: justify;\">Tuttavia, per quanto riguarda lo\u00a0smart working, il\u00a0decreto-legge 7 ottobre 2020 n. 125 prevede che tale modalit\u00e0 lavorativa possa essere utilizzata per tutto il tempo dello stato d&#8217;emergenza, ma \u00abcomunque non oltre il 31 dicembre 2020\u00bb.<\/p>\n<p style=\"text-align: justify;\">Ci\u00f2 implica che, indipendentemente dal fatto che l&#8217;emergenza sanitaria prosegua nel 2021, allo stato, lo smart working \u201csemplificato\u201d non si potr\u00e0 comunque utilizzare dopo il 31 dicembre 2020.<\/p>\n<p style=\"text-align: justify;\">Infatti, come riportato anche nelle FAQ del Ministero del Lavoro, il riferimento della norma al 31 dicembre 2020, \u00e8 da intendersi come limite massimo di applicazione della procedura semplificata, nel caso di proroghe allo stato di emergenza.<\/p>\n<p style=\"text-align: justify;\">Pertanto, fino al 31 dicembre 2020 lo smart working potr\u00e0 essere attivato, in deroga alle previsioni della legge n. 81 del 22 maggio 2017, senza necessit\u00e0 di accordo tra le parti.<\/p>\n<p style=\"text-align: justify;\">Operativamente, quindi, anche ai fini amministrativi sar\u00e0 possibile una comunicazione semplificata al Ministero del Lavoro, mentre rimane necessaria l&#8217;informativa sulla sicurezza da consegnare al lavoratore.<\/p>\n<p style=\"text-align: justify;\">\u00a9 FTA avvocati.
